Terms of service

1. Who we are and what you accept

These terms govern the use of the Tapewise software, its updates, the licence server and the related services ("Tapewise", "we"). By buying a licence or using the software you accept these terms, the refund policy and the privacy policy. Contact: contact@tapewise.app.

2. The licence

• We give you a personal, non-exclusive, non-transferable licence to use the software for the period you paid for. The software remains ours: you buy the right to use it, not the program.
• The licence is tied to your Discord account and covers one computer at a time. If you change PC you move it from the app, up to twice a month.
• The app checks the licence with our server every few hours and keeps working for up to two days offline.
• Every period (monthly or annual) is paid separately: there is no automatic renewal. When it ends without a renewal the app stops; your data stays on your PC.
• The Founder role on Discord is a community recognition: it does not entitle you to a licence without an end date.

3. What is not allowed

• Sharing the licence: giving, lending, reselling or using it with other people, even splitting the cost, or using it on several computers at once.
• Sharing your Discord account or the app's session so that others can use Tapewise.
• Copying, modifying, decompiling or analysing the software to obtain its code, except where the law allows it anyway.
• Circumventing, or trying to circumvent, the licence check, the app's seal or the other protections.
• Distributing the installer, the app's files or the updates outside our channels.
• Using Tapewise to redistribute CME or other exchange market data to third parties: the data is licensed to you by your provider and remains subject to its agreements.
• Using our servers in a way that damages or overloads them.

If you break these rules we may suspend or end the licence, also without notice and without refunding the current period. Every licence may carry marks that let us recognise it.

4. Market data and third-party services

Tapewise does not sell market data. It needs a Rithmic account with a CME data subscription, from your broker or prop firm: the costs, terms and availability of those services are theirs. Orders you send from Tapewise go through your Rithmic account and are executed by your broker. We are not responsible for the data, order execution, outages or the rules of brokers, prop firms, Rithmic, exchanges, Discord or PayPal.

5. Risk warnings

• No advice. Tapewise shows data and calculations (order flow, levels, indicators, statistics). Nothing you see in the app, on the site, on Discord or in the guides is a recommendation to buy or sell, nor investment, tax or legal advice.
• High risk. Futures and options are leveraged: you can quickly lose large sums, even more than the capital you deposited. Only trade with money you can afford to lose.
• Simulated results. Backtests, optimisations and simulated trading have inherent limits: they don't account for every cost, real execution and market conditions, and they are built with hindsight. Past results, real or simulated, do not guarantee future ones.
• Calculations and levels. Greeks, options exposure, levels and signals are estimates based on models and assumptions, and may be wrong or late.
• Technology. Software, connections, computers and servers can fail, lag or show incomplete data. Always check orders and positions on your broker's platform too, and keep an independent way to close them.
• Your decisions. Every order you send, by hand or with the app's automatic features (brackets, stops, targets, break-even), is your decision and your responsibility.

6. The software "as is"

We work to make Tapewise fast, stable and correct, but the software is provided as is and as available: we do not warrant that it is error-free, that it runs without interruption or that it fits a particular purpose. We may update it, change or remove features and pause the licence server for maintenance. The rights the law gives consumers, such as the conformity guarantee for digital content, remain.

7. Limits of liability

To the extent the law allows, we are not liable for trading losses, lost profits, data loss, orders filled or not filled, nor for indirect or consequential damage linked to using the software or being unable to use it. In any case our total liability does not exceed what you paid us in the 12 months before the event. These limits do not apply to damage caused wilfully or by gross negligence, nor where the law does not allow them.

8. Payments and refunds

You pay on our Discord server with PayPal; the licence is activated as soon as we confirm the payment. Purchases are final: the rules, including exceptions such as double charges, are in the refund policy.

9. Changes

We may update these terms, for example for new features or because of the law. The terms in force are always on this page with their date; important changes are announced on the Discord server. New terms apply from the period after the one already paid, unless they are in your favour or required by law.

10. Governing law

These terms are governed by Italian law. If you are a consumer, the rights the law of your country of residence gives you remain, and you may go to the court where you live. For any problem write to us first at contact@tapewise.app: we always try to solve it together.
